THEORETICAL AND LEGAL ANALYSIS OF THE HIERARCHICAL STATUS OF THE CONSTITUTION OF THE REPUBLIC OF UZBEKISTAN AND INTERNATIONAL TREATIES OF THE REPUBLIC OF UZBEKISTAN

This article analyzes the issue of the legal hierarchy between the Constitution of the Republic of Uzbekistan and international treaties from both theoretical and practical perspectives. During the research, the concepts of monism and dualism, general legal theories concerning the hierarchy of normative legal acts, as well as the principles for resolving legal conflicts were examined. In addition, the constitutional practices of the United States, France, Türkiye, Albania, the Czech Republic, Croatia, Romania, Bosnia and Herzegovina, and the Russian Federation were studied on the basis of comparative legal analysis. The article systematically interprets the provisions of the Constitution of the Republic of Uzbekistan, the Law “On International Treaties,” and the legislation on the Constitutional Court, substantiating the supreme legal force of the Constitution. The study concludes that although international treaties constitute a component of the national legal system, they do not prevail over the Constitution.
