IMPROVING PROCEDURAL MECHANISMS FOR CHECKING THE ADMISSIBILITY OF EVIDENCE BY THE INVESTIGATIVE JUDGE AT THE PRE-TRIAL STAGE

The thesis analyzes the role of the newly introduced institution of the investigative judge in verifying the admissibility of evidence in criminal proceedings. The author identifies the lack of a mechanism for “filtering” illegally obtained evidence at the pre-trial stage as a primary issue. Based on the experiences of France and Italy, and the views of international scholars (M. Damaška, M. Delmas-Marty), it is proposed to grant the investigative judge the authority to declare evidence inadmissible by amending Articles 95-1 and 405-11 of the Criminal Procedure Code.
