"THE LEGAL SIGNIFICANCE OF THE INSTITUTE OF CRIMINAL RECORD IN THE PROTECTION OF HUMAN RIGHTS"
Abstract
This article provides a comparative legal analysis of the consequences of having a criminal record, examining both its criminal-law and general-legal implications from the perspective of human rights and freedoms. It is proposed to classify directly substantive criminal-law, criminal-procedural, and penal (penitentiary) consequences under the scope of criminal-law implications. General-legal consequences are identified as restrictions on individual rights and freedoms across constitutional, civil, labor, family, and other branches of law. The study substantiates that general-legal consequences differ from criminal-law ones because they are codified within sectoral legislation rather than criminal, criminal-procedural, or penal codes. Furthermore, it highlights that such consequences may persist even after the conviction is expunged or spent, extending their legal impact beyond the convicted individual to occasionally affect close relatives or other third parties.
