CRITERIA FOR ASSESSING THE BEST INTERESTS OF THE CHILD IN ADOPTION PROCEEDINGS AND JUDICIAL PRACTICE

This article examines the legal criteria for assessing the interests of the child in adoption proceedings in accordance with the legislative norms of the Republic of Uzbekistan. The article analyses the three-dimensional nature of the “best interests of the child” principle — its operation as a substantive legal norm, a principle of legal interpretation, and a procedural rule. Personal criteria relating to the child (age, health, wishes, and connection with the biological family) as well as requirements imposed on prospective adoptive parents (a system of affirmative conditions and “negative filters”) are studied. Within the framework of Resolution No. 16 of 2011 of the Plenary Session of the Supreme Court of the Republic of Uzbekistan, the procedural characteristics of judicial proceedings in adoption cases are analysed — jurisdiction, the range of participants, closed court hearings, and grounds for the annulment of adoption. The study provides a scholarly justification for the necessity of incorporating the criterion of psychological readiness into the assessment system, as well as eliminating the legal gap concerning the preservation of the child’s connection with the biological family.
