ROLE OF PARTIES' AUTONOMY IN THE MAKING OF INTERNATIONAL ARBITRATION AGREEMENTS

International commercial arbitration is an alternative dispute settlement based on the principle of party autonomy. Parties’ autonomy and their will are crucial in International commercial arbitration. Arbitration processes begin only when parties agree to start processes. Parties fulfill their autonomy by drafting an arbitration agreement to resolve their current or future disputes. Drafting an arbitration agreement is the first step to realize parties’ autonomy in International commercial arbitration. Briefly, arbitration agreements are guarantees to commence arbitration processes whenever there is a dispute between parties.Downloads
