Аннотация:
Ўзбекистон Республикаси Фуқаролик кодексининг 1102-моддасига мувофиқ, товар белгисига нисбатан ҳуқуқ давлат рўйхатидан ўтказиш ва тегишли гувоҳнома билан тасдиқланганлик асосида вужудга келади. Гувоҳнома ҳуқуқ эгасига товар белгиси рўйхатга олинган товар(лар)ни ишлаб чиқариш, ундан фуқаролик-ҳуқуқий шартнома муносабатларида фойдаланиш, ҳуқуқни тасарруф этиш имконини беради. Қолаверса, ҳуқуқ эгаси товар белгиси билан адаштириб юбориш даражасида уларга айнан ўхшаш бўлган белгиларни учинчи шахслар томонидан фойдаланишни, хусусан товар ишлаб чиқариш ва уни сотишни, ундан домен номи, фирма номи, хизмат кўрсатиш белгиларидан фойдаланиш ва рўйхатдан ўтказишни тақиқлайди.
