Abstract
Ushbu maqolada jinoyat huquqining o‘ziga xos tabiat va boshqa huquq sohalaridan ajratib turuvchi asosiy konseptual belgilari tahlil qilinadi. Tadqiqotda kriminallashtirish (criminalization) tushunchasi, ex ante va ex post vakolatlar hamda protsessual majburiyatlar tizimining huquqiy mohiyati yoritilgan. Shuningdek, maqolada davlatning jinoiy ta’qib bo‘yicha monopoliyasi, shaxsga nisbatan taklif etiladigan protsessual kafolatlar va jinoiy jazolashning fuqarolik-huquqiy javobgarlikdan (kompensatsiyadan) farqli jihatlari ilmiy-falsafiy tomondan ochib beriladi.
